Agreement to these terms

These Terms of Use apply to your use of silvaraautomotive.com (the "site"), operated by Silvara Automotive Group Inc., a dealer-to-dealer wholesale vehicle brokerage. By using the site you agree to these terms. If you do not agree, please do not use the site.

If you engage us to source, place or appraise a vehicle, our Brokerage Service Terms and any written deal confirmation also apply.

What the site is for

The site describes our brokerage services for automotive dealers and lets you contact us or request a call. It is intended for dealers and other businesses. Private vehicle owners are welcome to contact us, and we will explain how a private sale works before anything is agreed.

Information on the site

  • General information only. Content on the site is general information about our services. It is not an offer to buy or sell any vehicle and it does not create a contract.
  • Illustrative examples. The intro film, The Matcher demonstrations, sample units, buyer lists, regions and match scores shown on the site are illustrative. They are not live data, past transactions or a promise of any result.
  • Offers. An offer for a vehicle is made by a buying dealer, is communicated to you in writing, and is conditional until inspection is complete.
  • No advice. Nothing on the site is legal, tax, accounting, customs or regulatory advice. Rules differ by province, state and situation, so confirm your position with your own advisers.
  • Accuracy. We work to keep the site accurate and current, but we do not guarantee that it is complete or free of errors, and we may change it at any time.

Using the site

You may use the site for lawful purposes connected with considering or using our services. You agree not to:

  • copy, scrape or harvest content or contact details from the site, including by automated means;
  • interfere with the site's operation or security, or try to access systems or data you are not authorised to access;
  • submit false, misleading or someone else's information, or anything unlawful, harmful or infringing;
  • use the site to send unsolicited commercial messages.

What you send us

When you submit a form or message, you confirm that the information is accurate and that you are entitled to share it. We handle it as described in our Privacy Policy.

Intellectual property

The site and its content, including text, design, graphics, video, the Silvara name and logo, and The Matcher name and character, belong to Silvara Automotive Group Inc. or its licensors and are protected by Canadian and international law. You may view and print pages for your own business use. Any other use, including reproducing, modifying or distributing the content or using our names or marks, requires our written permission.

Disclaimer

To the fullest extent permitted by law, the site is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the site will be uninterrupted, secure or free of errors or harmful components.

Limitation of liability

To the fullest extent permitted by law, Silvara Automotive Group Inc. and its directors, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of, or inability to use, the site. Our total liability for any claim arising from your use of the site is limited to one hundred Canadian dollars (CAD $100).

Nothing in these terms limits liability that cannot be limited by law, or any right you have as a consumer under consumer protection legislation, including Manitoba's Consumer Protection Act and Business Practices Act, which cannot be waived.

Indemnity

You agree to indemnify Silvara Automotive Group Inc. against claims, losses and costs, including reasonable legal fees, arising from your breach of these terms or your misuse of the site.

Governing law

These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there. You and we submit to the exclusive jurisdiction of the courts of Manitoba.

General

  • Changes. We may update these terms and will show the new date at the top. Continued use of the site after a change means you accept the updated terms.
  • Severability. If any part of these terms is found unenforceable, the rest remains in effect.
  • No waiver. Not enforcing a right is not a waiver of it.
  • Whole agreement. These terms, with our Privacy Policy and Cookie Policy, are the whole agreement about your use of the site. Our Brokerage Service Terms govern any services we provide.
